JUSTICE THOMAS delivered the judgment of the court, with opinion. Chief Justice Kilbride and Justices Freeman, Garman, Karmeier, Burke, and Theis concurred in the judgment and opinion. On August 23, 2007, severe storm systems affected the Chicago area, and there were numerous power outages to customers of the defendant in this putative class action, Commonwealth Edison Company. Five days later, the first of sequence of Cook County complaints was filed. At issue here is the third amended complaint, which was dismissed with prejudice. The circuit court also refused to allow the filing of fourth amended complaint. The appellate court affirmed.
