Justices Freeman, Burke, and Theis concurred in the judgment and opinion. Justice Garman dissented, with opinion, joined by Justices Thomas and Karmeier. In 2007, this Cook County defendant was brought to trial for the 2002 criminal sexual assault of woman who lived on the south side of Chicago. She had left her home at midnight to go to store. Subsequently, she identified defendant in police lineup. At trial, she testified as to how this defendant pushed her into van and raped her. sex offense involving this defendant had also allegedly occurred in 2003, later than the offense at issue, but brought to trial earlier. In that case, the defendant was acquitted. That victim testified as to how the defendant had dragged her through some bushes and raped her when she was out late at night in the south suburb
