Chief Justice Kilbride and Justices Thomas, Karmeier, Burke, and Theis concurred in the judgment and opinion. Justice Freeman dissented, with opinion. ' & \ marital home was claimed by her stepson, who brought an action in forcible entry and detainer to remove her from the property. She had thought she was joint tenant with her husband and was entitled to the premises by right of survivorship. An attorney, the defendant here, had been retained in 1997 to create joint tenancy, but did not succeed in doing so. He drafted quitclaim deed purporting to convey from the husband individually to the husband and wife as joint tenants. However, legal title was not in the name of the husband individually, but was held by land trust which provided that the premises would go & \ plaintiff filed this legal malpractice
