  • CHIEF JUSTICE KILBRIDE delivered the judgment of the court, with opinion. Justices Freeman, Thomas, Garman, Burke, and Theis concurred in the judgment and opinion. Justice Karmeier specially concurred, with opinion. In 2003, this plaintiff, Jane Studt, went to the emergency room of Sherman Hospital in Kane County, complaining of abdominal pain. She was prescribed medications for a urinary tract infection and pain and sent home.
