This Cook County offender pled guilty in 1998 to misdemeanor cannabis offense and was sentenced to time served (two days). In 2010, he filed motion in the circuit court to withdraw his guilty plea and vacate his conviction, alleging that he was Mexican citizen who was lawful permanent resident and whose petition for citizenship was being denied because of his conviction. He also alleged that he was subject to removal. He further alleged that, years earlier, the circuit court had failed to properly advise him of his appeal rights when his guilty plea was accepted.
