Chief Justice Kilbride and Justices Thomas, Karmeier, and Theis concurred in the judgment and opinion. Justice Freeman dissented, with opinion, joined by Justice Burke. In 2003, an $8 million loan was made by LaSalle National Bank for the purchase of land and construction of senior apartments on acres in Bolingbrook. The lending bank took mortgage on the land, whose value was less than the amount of the loan. It also began making payments, drawing on this loan, to the contractors who initially worked on the project. They did not file mechanics liens. The project was not successful and foreclosure was initiated in 2005. At that time, there were unpaid contractors who held perfected mechanics liens. Two of them are involved in this appeal.
