JUSTICE THEIS delivered the judgment of the court, with opinion. Chief Justice Kilbride and Justices Thomas, Garman, and Karmeier concurred in the judgment and opinion. Justice Burke dissented, with opinion, joined by Justice Freeman. These two defendants were convicted of burglary in a joint Cook County bench trial, but appealed separately.
