  • JUSTICE KARMEIER delivered the judgment of the court, with opinion. Chief Justice Kilbride and Justices Freeman, Thomas, Garman, and Burke concurred in the judgment and opinion. Justice Theis took no part in the decision. The parties involved in this appeal were all named as defendants in a medical malpractice action. In February of 2003, a man had gastric bypass surgery at MacNeal Hospital.
