Chief Justice Thomas and Justices Freeman and Kilbride took no part in the decision. In 2003, a multiple-vehicle collision involving a tractor-trailer occurred on Interstate 90 in McHenry County, resulting in the deaths of 8 individuals and injuries to 12 others.
