JUSTICE GARMAN delivered the judgment of the court, with opinion. Chief Justice Fitzgerald and Justices Thomas and Karmeier concurred in the judgment and opinion. Justice Freeman concurred in part and dissented in part, with opinion, joined by Justices Kilbride and Burke. Contraband found in connection with otherwise routine traffic stops resulted in criminal charges in these two cases. In the Will County case, Michael Cosby was convicted by a jury for unlawful possession of cocaine in 2001 on the basis of crack cocaine found in personal property he had been carrying on his person. In the Kane County case, Hugo Mendoza was charged with unlawful use of a weapon on the basis of a handgun found in his car in 2004. The circuit court suppressed that evidence and the State is the appellant in the action.
