  • Appellate citation: 375 Ill. App. 3d 595. JUSTICE KILBRIDE delivered the judgment of the court, with opinion. Chief Justice Fitzgerald and Justices Freeman, Thomas, Garman, Karmeier, and Burke concurred in the judgment and opinion. The City of Chicago charges franchise fees to cable television companies pursuant to agreements with them. In 2002, the Federal Communications Commission, which regulates such agreements, issued a ruling interpreting the federal Cable Communications Policy Act to mean that such fees cannot be based on revenue derived from cable modem service, which provides internet access.
