- JUSTICE THOMAS delivered the judgment of the court, with opinion. Chief Justice Kilbride and Justices Freeman, Garman, Karmeier, Burke, and Theis concurred in the judgment and opinion. In December of 2000, in broad daylight, a woman who was getting out of her vehicle in the Sears parking lot off of Western Avenue in Chicago was approached by this defendant, who pushed a gun into her ribs and told her to leave her keys in the ignition and get out. He then drove away. In January, the vehicle was recovered, defendant was arrested, and she identified him.
