- JUSTICE FREEMAN delivered the judgment of the court, with opinion. Justices Thomas, Kilbride, Garman, Karmeier, and Burke concurred in the judgment and opinion. Chief Justice Fitzgerald took no part in the decision. In the summer of 1996, a melee ensued at a barbeque party on the south side of Chicago. Members of rival gangs were present, and a fatal shooting occurred.
