Chief Justice Fitzgerald and Justices Thomas, Kilbride, Garman, Karmeier, and Burke concurred in the judgment and opinion. In the summer of 2004, Chicago police responded to a report that a woman walking to her place of employment had been kidnapped and sexually assaulted near West 62nd Place and Kedzie Avenue.
