Justices Thomas, Kilbride, Garman, Karmeier, and Burke concurred in the judgment and opinion. Justice Freeman took no part in the decision. In 2006, online purchasers from Wal-Mart filed this putative class action in Cook County, complaining that they were charged sales tax on the shipping charges for items purchased on the internet and delivered to them.
