App. 3d 203. JUSTICE BURKE delivered the judgment of the court, with opinion. Chief Justice Thomas and Justices Freeman, Fitzgerald, Garman, and Karmeier concurred in the judgment and opinion. Justice Kilbride specially concurred, with opinion. This defendant was charged in connection with an incident that took place in the Silver Moon Tavern in Quincy in 2004. After patron removed his hand from some change lying on the bar, which he had received from the bartender, defendant Pierce grabbed the money and ran out of the tavern. Pierce was subsequently charged, and convicted, in the circuit court of Adams County with the Class felony of theft from the person of the victim. Defendant requested, and was refused, an instruction on the lesser offense of misdemeanor theft, which is not "from the person." T
