App. 3d 914. JUSTICE FREEMAN delivered the judgment of the court, with opinion. Chief Justice Thomas and Justices Fitzgerald, Kilbride, Garman, Karmeier, and Burke concurred in the judgment and opinion. Almost years ago, taxi driver was shot to death in Elmhurst. For this offense, defendant Phillip E. LaPointe has been serving natural life sentence. In 1998, LaPointe began filing series of collateral challenges to his conviction, including postconviction petition, which was dismissed by the circuit court of Du Page County. In 2004, he filed second postconviction petition without, however, seeking leave of court, as is required by statute. Subsequently realizing this, he made motion seeking leave to file successive postconviction petition, but that motion for leave was denied. In this appeal he
