Chief Justice Thomas and Justices Freeman, Fitzgerald, Kilbride, Garman, and Burke concurred in the judgment and opinion. State Farm Automobile Insurance Company initiated this Cook County lawsuit against Illinois Farmers Insurance, complaining of policies issued by the latter. These policies had "omnibus clauses" which allowed coverage levels for permissive automobile users to be lower than for named insureds, although still meeting the required statutory minimums.
