Wheeler Appellate citation: No. 4-02-0131 (unpublished order under Supreme Court Rule 23). JUSTICE GARMAN delivered the judgment of the court, with opinion. Chief Justice Thomas and Justices Freeman, Fitzgerald, Kilbride, Karmeier, and Burke concurred in the judgment and opinion. In March of 1999, man who was expected to be witness at the trial of this defendant in an unrelated matter was shot to death in Decatur. Police who heard gunfire saw two black men wearing dark winter clothing fleeing from the scene. The pursuit of them yielded this defendant, who was found hiding under bush, and codefendant, Shannon Hunter, who was arrested on the front porch of house.
