Justices Freeman, Fitzgerald, Kilbride, Garman, and Karmeier concurred in the judgment and opinion. Justice Burke took no part in the decision. This Cook County defendant was convicted for the 1994 murder of one person and the attempted murder of another in shooting which took place at 1631 West Wallen in Chicago. Piatkowski had been convicted principally on the identification testimony of two members of the group which was fired upon, including the attempted murder victim. The jury was instructed to consider five prescribed factors in evaluating the identification testimony.
