CHIEF JUSTICE THOMAS delivered the judgment of the court, with opinion. Justices Freeman, Fitzgerald, Kilbride, Garman, Karmeier, and Burke concurred in the judgment and opinion. In 2003, purse was snatched from 61-year-old woman in front of store in Rockford. There were several eyewitnesses. This defendant was indicted for the robbery of person years of age or over. The Winnebago County jury that heard the case returned signed verdict form finding Green guilty of robbery. The circuit court imposed sentence of years because of the victim's age. Robbery of person years or older is Class felony. On appeal, the defendant complained that the verdict form did not literally find him guilty of robbing an older person, which was the basis for the more serious felony classification and higher sentence.
