JUSTICE FREEMAN delivered the judgment of the court, with opinion. Chief Justice Thomas and Justices Fitzgerald, Kilbride, Garman, and Karmeier concurred in the judgment and opinion. Justice Burke took no part in the decision. In 1990, fatal shooting occurred at 2624 West Fullerton Avenue in Chicago. This defendant and another man were arrested and charged. The other man was acquitted after bench trial at which 16-year-old eyewitness implicated both that other man and the defendant. The other man has since been deported to Mexico and the eyewitness has died. This defendant, however, did not immediately stand trial because he fled.
