Description: Department of Central Management Services (Department of Juvenile Justive) vs American Federation of State, County, and Municipal Employees, Council 31: Section 6.1 of the Illinois Public Labor Relations Act, 5 ILCS 315/6.1 (2012), added by Public Act 97-1172, allows the Governor of the State of Illinois to designate certain public employment positions with the State as excluded from the collective bargaining rights which might otherwise be granted under the Illinois Public Relations Act. Section 6.1 and Public Act 97-1172 became effective on April 5, 2013 and allow the Governor 365 days from that date to make such designations. Description: City of Elgin -vs- Elgin Association of Fire Fighters, International Association of Firefighters, Local 439: On October 9, 2013, Administrative Law Judge (ALJ) Heather R. Sidwell issued an Order in the above-referenced case, denying a union's motion to defer to arbitration. The charge had been filed by the City of Elgin on October 2, 2012, alleging violations of Sections 10(b)(4) and 10(b)(1) of the Illinois Public Labor Relations Act, 5 ILCS 315 (2012). After investigation, Executive Director Melissa Mlynski issued a complaint for hearing on August 30, 2013. Respondent Elgin Association of Fire Fighters, IAFF, Local 439 (Union), filed a timely answer on September 17, 2013, and one week later, on September 24, 2013, filed a motion to defer the complaint to arbitration. On October 2, 2013, the City filed a response in opposition to the motion to defer which, as mentioned, was denied by the ALJ.

Description: American Federation of State, County and Municipal Employees, Council 31 -vs- Department of Central Management (Pollution Control Board): On March 5, 2013, Administrative Law Judge (ALJ) Heather Sidwell issued a Recommended Decision and Order (RDO) in the above-captioned case in which she determined that two employees of the Illinois Department of Central Management Services (Employer or CMS), Alisa Liu and Anand Rao, working at the Pollution Control Board (PCB) in the titles Environmental Scientist I and II, respectively, are public employees within the meaning of Seciton 3(n) of the Illinois Public Labor Relations Act, 5 ILCS 315/3(n) (2012). The ALJ rejected the Employer's contention that the positions are managerial employees within the meaning of Section 3(j) of the Act and recommended that the positions be added to the RC-63 bargaining unit.

Description: American Federation of State, County and Municipal Employees, Council 31 -vs- Department of Central Management Services (Illinois Commerce Commission): On February 27, 2013, Administrative Law Judge (ALJ) Heather Sidwell issued a Recommended Decision and Order addressing a petition filed by the American Federation of State, County and Municipal Employees, Council 31 (Petitioner of Union) that sought to add sic employees of the State of Illinois, Department of Central Management Services (Employer), in the job title Director at the Illinois Commerce Commission (ICC), to the RC-63 bargaining unit. The ALJ recommended that the Illinois Labor Relations Board, State Panel, find that Jerry Oxley and Peter Muntaner are managerial employees within the meaning of Section 3(j) of the Illinois Public Labor Relations Act, 5 ILCS 315 (2012), who should be excluded from collective bargaining. Further, she recommended that Torsten Clausen should be excluded on the basis that he is managerial as a matter of law. Next, she recommended that the Board find that Harry Stoller, joy Nicdao-Cuyugan, and Jim Zolnierek are public employees within the meaning of Section 3(n) of the Act, whose positions should be added to the unit. Finally, she rejected the Employer's contentions that ahy of the petitioned-for employees are supervisory or confidential employees within the meaning of Sections 3(r) and 3(c) of the Act, or because they are excluded from certain protections of the Personnel Code, 20 ILCS 415 (2012), and/or exempt from the requirements arising out of the Supreme Court's ruling in Rutan v. Republican Party of Ill., 497 U.S. 62(1990).

Description: International Brotherhood of Teamsters, Local 700 -vs- Illinois State Toll Highway Authority: On January 23, 2015, Administrative Law Judge Deena Sanceda (ALJ) issued a Recommended Decision and Order in the above-captioned case, recommending the Illinois Labor Relations Board, State Panel, find that employees in the title of Sign Shop Manager, Sign Shop Supervisor, Road Electric Manager, Central Garage Manager, and Central Garage Supervisor employed by the Illinois State Toll Highway Authority were not supervisors within the meaning of Section 3(r) of the Illinois Public Labor Relations Act, 5 ILCS 315 (2014), as amended, (Act), and that a secret ballot election should be conducted among those employees to determine if they wished to be represented by the International Brotherhood of Teamsters, Local 700, or have No Representation. Description: James Young -vs- Village of University Park: On May, 2015, Executive Director Melissa Mlynski issued a order holding in abeyance the above-captioned matter, pending final disposition of related contractual grievance. On January 15, 2015, James Young, (Charging Party) filed a 17-page charge, which alleged that the Village of University Park (Respondent) engaged in unfair labor practices within the meaning of Section 10(a)(1) of the Illinois Public Relations Act, 5 ILCS 315 (2014, as amended). As a part-time employee of Respondent, Charging Party was a member of a bargaining unit represented by the American Federation of State County and Municipal, Local 3837 (AFSCME) and covered by a collective bargaining agreement (CBA) between AFSCME and Respondent. The Executive Director determined that specific conduct alleged in the charge is covered by a series of grievances that are currently pending on behalf of Charging Party under the CBA's grievance procedure.

Description: International Association of Machinists and Aerospace Workers, District 8 vs Department of Central Management Services (Department of Human Services): In June 2012, after receiving signature authority from approximately 70 state employees sharing the title of local office administrator within the Department of Human Services (Department), the International Association of Machinists and Aerospace Workers, District 8 (Association), filed a majority interest petition with the Illinois Labor Relations Board, State Panel (Board), requesting bargaining unit representation. In July 2012, the local office administrators' employer, the Department of Central Management Service (CMS), filed an opposition to the petition. On September 26, 2012, an administrative law judge (ALJ) issued a decision and order recommending the Board dismiss the Association's petition. In January 2013, the Board issued a written decision and order adopting the ALJ's recommendation and dismissing the Association's petition.

To further that stated objective, the General Assembly passed a statute that gave the Governor the authority to designate up to 3,580 state employment positions. In response, the Union filed a petition for administrative review of the Board's decision in our court. On appeal, it contends that the District's complaint against it was procedurally defective and that the Board improperly relied on conduct outside the appropriate statute of limitations in rendering its decision, that the Board erred by failing to examine the totality of the circumstances, tha the Board erred in not dismissing the District's complaint as moot, and that the Board's order is void because it did not have the authority to vacate the prior arbitration award. The Union asks that we enter an order reversing and vacating the Board's order, particularly, its bad faith finding and its remedial affirmative bargaining order.

Description: American Federation of State, County and Municipal Employees, Council 31 -vs- County of Kankakee and Kankakee County State's Attorney: On October 30, 2014, Charging Party, American Federation of State, County and Municipal Employees, Council 31, filed an unfair labor practice charge against Respondents County of Kankakee and Kankakee County State's Attorney, in which it alleged that the Respondents violated Section 10(a)(4) of the Illinois Public Labor Relations Act, 5 ILCS 315/10(a)(4) (2012), by: 1) direct dealing with a bargaining unit member, 2) providing a wage increase outside the scope of the collective bargaining agreement and without negotiating with the Charging Party; 3) unilaterally implementing changes in health insurance amist negotiations over a successor collective bargaining agreement and without notice or an opportunity to bargain; and 4) engaging in regressive bargaining and overall bad faith bargaining.
