Justice Thomas delivered the judgment of the court, with opinion.Chief Justice Fitzgerald and Justices Freeman, Garman, Karmeier, and Burke concurred in the judgment and opinion. Justice Kilbride took no part in the decision. This cause is before the Illinois Supreme Court on review of the granting of summary judgments for the defendants. No trial has occurred.

Illinois Department of Revenue Affirmative Action Plan for Fiscal Year 2010. The Final Availability Analysis provides a numerical measure of utilization through an analysis of the internal workforce of each state entity and the availability of affi rmative action groups in surrounding labor area(s). Comparison of the availability numbers and the actual number of affi rmative action groups currently employed by the agency will indicate whether or not the agency is underutilized. The resulting number becomes the ultimate goal of the agency.

Affirmative Action Plan for Fiscal Year... / Illinois Racing Board {periodical start}
The Illinois Racing Board consists of eleven members appointed to six year terms by the Governor with the advice and consent of the Senate. The Board is responsible for enforcement of the statute governing horse racing in Illinois known as the Illinois Horse Racing Act. Each year the Board issues racing licenses and establishes a racing schedule for each of the states operating racetracks, both thoroughbred and harness. The race date allocation processinvolves an assessment of each racetracks application for a racing license in view of the best interest of Illinois racing and such factors as the racetracks facilities and accommodations for the public; the tax revenues to be generated for the state from various race meets; the extent of promotional and marketing activities; the character, fitness, reputation and integrity of the activities;the character, fi tness, reputation and integrity of the racetracks owners and operators, and each racetracks compliance with affi rmative action plans.
